Akshat Khetan, Founder of AU Corporate Advisory and Legal Services, expressed his views on the Supreme Court’s temporary halt on the government’s demand of ₹1.12 lakh crore GST from online gaming companies.
He stated: “The Supreme Court’s decision provides temporary relief to the online gaming sector, which has been grappling with the imposition of a 28% GST on the entire value of players’ bets. The industry’s argument that the tax should only apply to net profits, not gross bets, reflects a legitimate concern about maintaining a sustainable business environment. Moreover, retrospective application of such a high tax rate undermines trust in regulatory predictability. While taxation is essential, it is critical to strike a balance that fosters industry growth while ensuring compliance. This development is a pivotal moment for policy-making in emerging sectors like gaming, where clarity and fairness are imperative for long-term success.”
