Mazgaon Sessions Court Issues Notice to Ex-Trustees of Lilavati Kirtilal Mehta Medical Trust U/S 304 IPC
Mumbai : – The Mazgaon Sessions Court has issued notices to the purported ex-trustees of the Lilavati Kirtilal Mehta Medical (LKKMM) Trust and HDFC CEO under section 304 of the Indian Penal Code (IPC), in connection with charges of culpable homicide filed by Permanent Trustees of Lilavati Hospital & Research Centre. The charges pertain to the alleged severe mental & Physical Harassment leading to the unfortunate demise of Mr. Kishore Mehta.
The charges are related to the alleged severe mental and physical harassment that reportedly led to the unfortunate demise of Mr. Kishore Mehta. The Permanent Trustees of Lilavati Hospital & Research Centre have accused Erstwhile board members Mr. Chetan Mehta, Mr. Rashmi Mehta, Mr. Bhavin Mehta, Mr. Niket Mehta, Mrs. Sushila Mehta, Mr. Nimesh Sheth, Mr. Ayushman Mehta and Mr. Sashidar Jagishan- MD & CEO HDFC Bank, Mr. Sudhir Kumar Jha – Legal Head, Legal & Group General counsel, HDFC Bank , Pranesh Rao- Head Department for special operations HDFC Bank and they claim those are directly contributed to this tragic incident.
Section 304 of the IPC addresses cases of culpable homicide not amounting to murder, with serious legal implications, including potential imprisonment. The issuance of the notice by the Sessions Court marks a critical step in this legal process.
Mr Prashant Mehta, Permanent Trustees – Lilavati Hospital & Research Centre said “Erstwhile board member have illegitimately asserted their claim to the trusteeship, exploited trust assets for personal gain, tarnish the trust reputation. This was highlighted in the Assistant charity commissioner’s order on December 14, 2023 which has rejected their claims to trusteeship. Additionally, he mentioned that there is clear collusion between purported ex trustees of Lilavati hospital and CEO of HDFC Bank. Mr. Kishore Mehta suffered both mental and physical distress due to a well-orchestrated conspiracy and misleading financial information, which resulted in him being unjustly labelled as a loan defaulter, despite having settled his loan with HDFC Bank during a serious illness.”
Advocate Asim stated, “A Revision Application has been filed in the said matter and the Hon’ble Sessions Court has issued a notice to the Respondents. The next hearing in this matter is scheduled for August 22, 2024.”
